Shop and Return Policies

Shipping and Packaging


Each painting or print is packaged in special packaging that is designed to keep it in good condition as it arrives at its destination. Original art is shipped in a box, a sturdy envelope or rolled in a tube, depending on the size of the painting. Fine art prints shipped in sturdy envelopes up to 9x12’’ size and rolled in a tube for larger sizes. If you have any questions about how your order would be packed, please contact me. All orders shipped with UPS Prime shipping service to the United States and most common destinations arrive within 2-7 business days from the shipment date. Please note that some countries or areas could be out of UPS service, and in those cases orders will be shipped with International Mail Services such as Registered Mail or High Priority International Mail. Tracking information is provided for all orders. All orders are shipped within 1-5 business days from the date of purchase. If you have any special requirements about shipping time please contact me.




Payments


We accept PayPal and all credit cards through the PayPal checkout system. If you don’t have PayPal account, you can use your preferred payment card as a guest, without a PayPal account.




International Orders


I'm not responsible for any custom duties or import VAT charges. Those will depend on your local laws and are different in every country. It is the buyer’s responsibility to pay duties when the package arrives at Customs in your country. Please check those policies before purchasing. Please note that the taxes and duties that you may be required to pay are NOT the payment for shipping. Taxes and duties are paid to the Customs Department in your country. Customs clearance is the documented permission the national customs authority grants to the imported goods. The customs clearance is typically given to a shipping agent to prove that all applicable customs duties have been paid and the shipment has been approved. The shipping provider may charge a customs clearance fee or customs handling fee for processing the import declaration, an advancement fee for paying the duty and VAT on behalf of the recipient, an airline handling fee for loading and unloading the goods, a security fee for screening or x-raying the goods and a fee for preparing the customs declaration. These charges will vary depending on the vendor that is used to import your package. It will usually appear as a brokerage fee in the customs invoice. The brokerage fee is also NOT the payment for shipping but for Customs Process. For example, Customs and Duties for international Orders for EU: https://ec.europa.eu/taxation_customs/individuals/buying-goods-services-online-personal-use/buying-goods/buying-goods-online-coming-from-a-noneu-union-country_en If your order is returned because of unpaid custom duties or/and VAT fees, the refund for the order would be 50% of the total paid cost minus shipping cost. This is because I would have to pay for its return as well as the local taxes and duties for returning products in my country.




Can I return the artwork I purchased?


All sales of original artwork are final. If you wish to return a reproduction print, a restocking fee amounting to 20% of the print (and varnish, if applicable) cost will be applied. We are more than happy to exchange a print for you, but keep in mind that the restocking fee for the original print will still be applied.




How long do I have to return or exchange a print?


Please open and check your prints immediately upon receipt. We accept print returns and exchanges within 7 days of receipt. If you do not reach out to us within 7 days, we will be unable to make a return, so please be prompt! Please note the above restocking fee (please see response to “can I retire the artwork I purchased?”). Please note that this timeline is flexible during the winter holiday season. Please be aware that an exchange may not arrive in time for Christmas if the new print is unable to be printed until after December 13th, as we fulfill exchange requests only after receiving the returned print.




I purchased a print, but now it’s on sale. Can I have the discount applied retroactively?


Absolutely! We are happy to issue you a retroactive discount if the purchase was made within a week of the beginning of the sale.




When will my replacement artwork ship / When will I receive my refund?


If you contact us with an issue and we inform you that we will be sending out a replacement or issuing a refund, we will ship your replacement artwork and / or issue a refund only after receiving your return + communication via email.




What packaging do I use to send the print back?


We ask that you return your print in the original packaging. If your print came in a tube, it must be returned with both end caps. If you opened the package and threw one end cap away, tape is not a replacement! We are only able to provide you a functioning shipping label if the weight and dimensions are accurate and the same as when we initially shipped the package. If you do not have the original packaging, please go to the post office and purchase a stiff mailer or a sturdy tube, as well as postage. We will not provide you a refund for artwork that is damaged in transit back to the studio due to poor packaging. We are unable to restock and sell damaged prints, so please make sure you package your print with care!




My artwork arrived damaged OR was not delivered OR was lost OR was stolen from my doorstep. Is this something you can help with?


We are not liable for any mishandling or failed delivery by the shipping service (USPS or UPS, domestically or internationally), and we are not liable for any damage incurred post-delivery. We work hard to package each order with care in sturdy flat mailers and tubes so that it arrives undamaged, and we recommend that you handle your new artwork with care when framing and stretching. Please be kind when reaching out and remember that we do not run the post office or UPS, and we have no control over the treatment of your package in transit. It’s just as much of a bummer for us to see damaged prints as it is for you to receive them. That being said, this is how we typically handle situations that fall outside of our control: Damaged Print: If your print is damaged in transit we are happy to handle this on a case by case basis with individual collectors who are able to provide details and documentation of the damage. Creasing and bends can be flattened. Collectors may be asked to file a claim with the shipping service. If the order is a complete loss and we offer a reprint, we ask that you return the print to our studio, either in the original packaging or in sturdy packaging purchased at your local post office. Collectors are responsible for shipping costs for replacement prints. We are unable to replace for free any prints damaged after delivery, so please place your print in a place away from possible water or heat damage, and handle the artwork with care when framing and stretching. Not Delivered / Lost / Stolen: If your package is marked “Delivered” and yet is nowhere to be found on your doorstep, please first check your confirmation email to ensure that you provided the correct shipping address. We are unable to replace any print order for free if the shipping address is incorrect. This does happen occasionally, and it is not uncommon to have the package returned to the studio. If that is the case, we are more than happy to forward it to your correct address, but we do however ask that you pay for the postage. If the address is correct and you believe your package to have been lost, stolen, or if you missed the delivery, you must contact the shipping service. Unfortunately, there isn’t anything we can do on our end, so we are unable to address any failed delivery or theft issues directly. If a package was not delivered, and is returned to our studio, we are happy to reship, but ask that you pay for the additional postage. We are unable to reprint any order for free that has not been delivered, lost, or stolen.




I ordered a print, but I’m unsatisfied with the colors now that it is in my space. What do I do?


Please take the time to read descriptions carefully and check the colors on multiple screens if you are concerned about color variations. I try my best to represent the colors and tones in my work honestly and clearly. We are happy to exchange your print for another that will work better in your space! Please see above for our exchange policy.

PRIVACY INFORMATION

Your privacy is very important to us. We do not share any personal, demographic, or financial data with any third party. We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contacts from you. We will not sell or rent this information to anyone.

 

SECURITY

Payment information is not retained by CanotStopPainting Studio and we take precautions to protect your information during this process. When you submit sensitive information via the website, your information is protected both online and offline.

Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way through a Payment Processing System (Paypal).

Collection of your Personal Information

In order to better provide you with products and services offered on our Site, CanotStopPainting Studio may collect personally identifiable information, such as your:

When you purchase CanotStopPainting Studio’s products and services, we collect billing and credit card information. This information is used to complete the purchase transaction but is held in an encrypted and secure payment processing service (Paypal). CanotStopPainting Studio has no access to this information.

However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the Site. Agreement between User and CANOTSTOPPAINTING Studio

Welcome to CanotStopPainting. The canotstoppainting.com website (the "Site") is comprised of various web pages operated by CanotStopPainting Studio. canotstoppainting.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of canotstoppainting.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

CanotStopPainting Studio (and Canotstoppaainting.com) is a service and commerce company offering Fine Art Paintings, Commissioned Paintings, Reproductions, Other Products & Goods, Courses, Classes, Workshops, Resources, Consultations, Mentorships, and all other products or services.

 

Rights to Artwork and Images

 

All artwork, images, and graphics are the sole property of CanotStopPainting and may not be used by any third party without written permission.  

 

Copying or reproducing artwork created by CanotStopPainting (as seen on CanotStopPainting.com, or elsewhere) is strictly prohibited without written permission from the artist.  

 

CanotStopPainting Studio retains all rights to all artwork until it has been purchased by a private or public collector at which time the collector receives the right to display the artwork in their home or business.  

CanotStopPainting Studio retains all rights to the image of all artwork including the rights to the image of sold & commissioned original paintings.

  

CanotStopPainting Studio retains the right to make REPRODUCTIONS OF ANY AND ALL ARTWORK CREATED BY CanotStopPainting UNLESS THE COLLECTOR HAS PURCHASED THE FULL OR PARTIAL RIGHTS TO THE ARTWORK in addition to purchasing the original painting.


Collectors of reproductions have the right to display the artwork in their home or business but retain no other rights to the artwork.  

 

Any image of the interior which includes the artwork in a 3rd party publication (such as social media, magazine, or book) must come with attribution (artwork title, artist's name).

All other uses must be agreed to in advance in writing.

Electronic Communications

Visiting Canotstoppainting.com or sending emails to CanotStopPainting Studio constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email, and on the Site, satisfy any legal requirement that such communications be in writing.

Cancellation/Refund Policy

Reproductions and non-original products: You may cancel your order within the first 24 hours. After 24 hours a 15% restocking fee will be applied. Returns and exchanges are handled on a case-by-case basis. We are not liable for any mishandling or failed delivery by the shipping service (USPS or UPS). Please contact sophie@canotstop.com within 7 days of receiving your artwork. 

Original Paintings: All sales of original artwork are final. Orders canceled within the first 24 hours will incur a 20% restocking & re-marketing fee.  Returns or exchanges of original work are not available except for the most extreme situations.

Canotstoppainting.com may contain links to other websites ("Linked Sites"). THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH INDIVIDUAL’S CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and CanotStopPainting Studio agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Termination/Access Restriction

CanotStopPainting Studio reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Israel and you hereby consent to the exclusive jurisdiction and venue of courts in Israel in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

 

You agree that no joint venture, partnership, employment, or agency relationship exists between you and CanotStopPainting Studio as a result of this agreement or use of the Site. CanotStopPainting Studio's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of CanotStopPainting Studio's right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by CanotStopPainting Studio with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

 

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and CanotStopPainting Studio with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and CanotStopPainting Studio with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
